CDE guidelines state:
The LEAs can keep with the record in 300 for a short period of time. They should refer back to their own policies and procedures for the duration, but it shouldn't exceed a month.
During that time the should document the work they are doing to find common ground and achieve mutual agreement with the parent. If after that time the parents still have not consented the LEA can input Plan Type 800 for this scenario.
They should continue to follow-up with their legal department to determine if they need to identify an alternative remedy to ensure that the child is receiving FAPE.
